TERMS AND CONDITIONS

The client assumes responsibility for the copyright and intellectual property rights of materials used in the projects. We disclaim any liability or responsibility for any infringement of intellectual property rights.

◦ The client is responsible for creating all necessary Windows, Apple, and Google Play Store accounts. Please note that setting up Apple Developer and Windows Store     accounts may take 2 to 4 weeks and should be initiated once the project commences.

◦ To ensure timely project completion, we aim to meet milestones punctually. To avoid delays, we expect the client to provide feedback, corrections, and bug fixes                   within 4 days of the  delivery of the respective module.

◦ Project deliverables may be affected by payment delays; therefore, timely payments on the agreed-upon dates are essential to avoid project delays.

◦ Hosting costs are subject to change based on usage. If increased usage necessitates server upgrades, we will propose necessary changes, and upon approval, we will       proceed with server amendments.

◦ Maintenance costs may vary depending on the final project code footprint. Any changes in maintenance costs will be communicated to the customer based on the             project’s requirements.

UI AND FUNCTIONALITY CHANGES AFTER CONFIRMATION OF THE ILLUSTRATED UI WOULD BE CONSIDERED AS VARIATION

◦ Typically, responsive designs are not encompassed within the scope of work for web designs. As a courtesy, we allocate an additional 2 days for responsive design             tasks for certain projects if explicitly outlined in the scope of work. Any work exceeding the allocated 2 days will be treated as a new scope of work and will be quoted     separately.

◦ All mobile user interfaces (UIs) will be crafted and implemented for portrait mode on phones unless alternative orientations and device types are explicitly specified         in the scope of work before commencing the project. Any additions of orientations and multiple device types (such as phones, tablets, desktops, etc.) will result in an         increased cost, as outlined in the agreed-upon scope of work.

◦ The provided costing does not cover the source code. If the client wishes to obtain the project source code, Codifyze will furnish a separate quote for that. The client       can inspect the source code through a remote session before making a purchase, and any such request should be submitted in writing if necessary. Once the source         code is delivered, Codifyze does not offer code-level knowledge transfer. The code’s quality is contingent on the expertise of the resource assigned to the project,             and we strive to  enlist the best talent in the market. The coding practices employed are at the discretion of the developers.

◦ Throughout the development phase, we will allocate a cloud storage space for the client to facilitate the exchange of project-related files. It is expressly prohibited to       use this storage space for personal purposes.

◦ Every variation will be documented in a variation tracker, and additional charges will be applied on top of the existing project cost.

◦ We don’t have a refund policy.

◦ Any identified bugs will be documented in the Bug Tracker, and approval from the project manager is required before initiating the necessary work for their                           resolution.

◦ Any request for variations will extend the development timeline. Clients should be aware that the inclusion of variations nullifies the previously specified deadline,           and a new deadline will be communicated to the client by the project manager.

◦ All communication should be documented via email for future reference. It is particularly important that client approvals for completed work be provided in email             format to maintain a record for documentation purposes.

◦ The source code will be stored in a source control repository. If the source code is included in the project deliverables, it will be transferred to the client upon the               completion of the project and settlement of all outstanding payments.

◦ We do not offer warranties or guarantees for any data loss. It is the client’s responsibility to back up their data before the commencement of projects. Once the client     agrees to a project/task start date, it is assumed that the client has taken all necessary precautions and backups for their data.

◦ The estimated duration may be subject to change in the presence of technical challenges or if research is required to deliver a component. Additionally, any                           alterations on the side of third-party libraries used in the application development may also impact the estimated duration.

◦ Periodically, Android, Apple, Amazon, and Windows may update their store policies, impacting certain apps. We cannot ensure a 100% success rate in publishing an         app, as the decision rests entirely with the store owners. We will exert our best efforts to implement any necessary changes to facilitate the publishing process. If any     of these changes fall outside the agreed-upon scope of work, they will be quoted separately. Once approved by the client, we will proceed with the necessary work.

◦ Disruptions to day-to-day activities caused by adverse weather conditions, natural disasters such as floods, storms, or earthquakes in our operational locations or             our contractor’s locations may impact the delivery of items. In such cases, new timelines will be communicated to the client.

◦ All our web projects are tested and developed on the latest browsers, including Chrome and Firefox as default choices. If there is a need for compatibility with any          other browsers, the client should make a specific request. Notably, support for Internet Explorer (IE) would be treated as a separate item and would incur additional        costs.
